Case Tracking by NyayAssist

Fair Use Policy

Last Updated: 29 October 2026

This Fair Use Policy ("Policy") governs access to and use of Case Tracking by NyayAssist, the court-case tracking service of NyayAssist, operated by Hyperboost AI Solutions Private Limited ("Company", "NyayAssist", "we", "us" or "our"). "You" or "User" means the individual using the product or, where the purchase is made for a law firm or other organisation, that organisation and its authorised users, as the context requires. Case Tracking on the web and in our mobile apps, and its associated interfaces, alerts and support, are referred to as the "Services".

This Policy applies to the Services. Whether a purchase also includes other NyayAssist features depends on the plan or order you accept, and the NyayAssist Terms of Use govern those other features. This Policy supplements the terms accepted at registration or purchase ("Terms") and the plan or written order accepted for the Services ("Order"). The Privacy Policy governs personal-data handling. The Refund and Cancellation Policy governs cancellation and refunds.

1. Permitted Use and Account Access

1.1 You may use the Services to track supported court and tribunal proceedings and organise related updates and reminders for your own lawful professional work or the work of the organisation identified in the Order, within the purchased entitlement. Acting for clients in the ordinary course of legal practice is permitted; reselling access to the software is not permitted unless separately authorised in writing.

1.2 Individual credentials must not be shared. Where a plan permits multiple users, each user must use the access method assigned to them. An organisation must designate authorised users, manage their permissions and remove access when authorisation ends. You must protect credentials and notify support promptly if you become aware of unauthorised access. You are responsible for activity you authorise and for misuse caused by your breach of these account-security duties; this does not transfer responsibility for a security failure attributable to the Company.

1.3 Users must be at least 18 years old and have authority to accept the Terms for themselves or the purchasing organisation. Access to a case record does not establish that a User represents a party to that proceeding.

2. Plan Entitlements and Usage Measurement

2.1 The Order or plan information displayed before purchase will identify the applicable usage entitlements. Depending on the plan, these may relate to authorised users, tracked cases, supported courts, searches, refresh requests, alert channels, exports and the period for which an entitlement is available. A numerical limit or paid overage applies only if disclosed and accepted before the relevant purchase or additional use.

2.2 The Company may measure usage through proportionate service and security records, in accordance with the Privacy Policy. Company-generated retries, duplicate processing caused by a system error and failed operations attributable to the Services will not be counted as successful billable operations. If you dispute a usage calculation, you may request a review and provide the relevant account, date and operation details.

2.3 Reaching a disclosed limit may prevent additional cases, searches or other incremental activity until the limit resets or you expressly purchase additional capacity. The consequences for existing tracked cases and scheduled alerts must be disclosed with the plan. The Company will not automatically enrol you in a higher-priced plan or levy an undisclosed penalty.

2.4 No rollover, pooled entitlement, bulk-access right or public API right arises unless expressly included in the Order. Legitimate use within the purchased entitlement is not a breach merely because it is frequent or commercially valuable to you.

3. Prohibited Activities

3.1 You must not use the Services to: (a) access another person's account or restricted records without authority; (b) bypass access controls, authentication, CAPTCHA, rate limits or payment restrictions; (c) deploy malware, overload systems or deliberately disrupt availability; (d) create multiple accounts to evade disclosed limits; (e) use unauthorised bots, scraping tools, bulk extraction or automation against the Services; or (f) provide unauthorised resale, sublicensing, shared-access or commercial data-feed services.

3.2 You must not use the Services for unlawful surveillance, harassment, doxxing, intimidation, impersonation, discriminatory profiling, unauthorised solicitation or any disclosure prohibited by law or a binding court order. You must not identify protected persons through combinations of case information or remove legally required redactions. Court information must not be altered or presented in a manner that falsely suggests an official certification, court endorsement or a result not reflected in the record.

3.3 You must not reverse-engineer or defeat the Services' security controls, except to the extent a restriction cannot lawfully be imposed. Security testing requires prior written authorisation defining its scope. Good-faith reporting of a suspected vulnerability is permitted; exploitation, unnecessary access to data and public disclosure of affected personal data are not.

3.4 Restrictions on extracting the Company's software, compilation or service do not give the Company ownership of public court records or prevent lawful access to those records directly from an authorised source. Exports expressly provided within your purchased entitlement remain permitted.

3.5 You may send case listings or reminders to a client only where that client has agreed to receive them and only in connection with your professional work for that client. You must not use the client messaging feature for marketing, solicitation or bulk messages.

4. Court Information, Updates and Alerts

4.1 The Services organise information obtained from supported sources. Coverage, source availability and update frequency are limited to the scope disclosed for the purchased plan. A missing result or an absence of alerts does not establish that no proceeding, hearing, filing, order or change exists. A match based on names or identifiers may require verification against the correct case and court.

4.2 Court portals, cause lists and other source systems may be unavailable, delayed, corrected, restructured or subject to access restrictions. Information displayed in the Services may therefore differ from a later or authoritative court record. A displayed refresh time is the time of the relevant retrieval attempt or successful retrieval, as identified in the interface; it is not a certification that the court record is complete or current.

4.3 Alerts are administrative assistance. They do not constitute service of process, an official court communication, a certified copy, a legal opinion or a determination of limitation or procedural deadlines. You remain responsible for verifying hearing dates, orders, deadlines and required action against the relevant authoritative record, and for maintaining an appropriate independent diary and review process.

4.4 Alert delivery may be affected by the source, your settings, inaccurate contact details, network conditions and third-party delivery systems. You must keep contact details current and check the relevant case information when an alert is important to an impending action. These qualifications do not excuse a failure by the Company to provide an expressly agreed service or remove a remedy that cannot lawfully be excluded.

5. Data Handling and Confidentiality

5.1 Provide only information needed for the supported case-tracking function. Do not submit court-account passwords, one-time passwords, payment credentials, privileged legal advice or confidential client documents through an unsupported field or support channel. You must have the authority and permissions required for information you supply and for any recipients you configure.

5.2 Public availability of a record does not authorise every further use or disclosure. You must observe applicable restrictions on protected identities, sealed or restricted proceedings, publication, confidentiality and professional conduct. The Company may restrict access to affected information while assessing a credible legal or security concern.

5.3 This Policy does not grant the Company a right to sell your watchlists, disclose your case selections to unrelated users, or use your case-tracking content for advertising or AI-model training. Personal-data handling and permitted service-provider access are addressed in the Privacy Policy.

6. Protective Measures and Enforcement

6.1 Where there are reasonable grounds to identify a breach of this Policy, the Company may use proportionate measures, such as limiting the affected operation, suspending an integration or account, or requiring remedial action. Except where urgent action is necessary to address a security threat, unlawful activity, a binding legal requirement or material harm to the Services or others, the Company will notify you of the concern and provide a reasonable opportunity to address it.

6.2 An ordinary entitlement limit will be administered under Section 2 and will not, by itself, be treated as misconduct. Where urgent restrictions are imposed, the Company will explain their general basis as soon as reasonably practicable, unless disclosure is legally prohibited or would materially compromise security or an investigation. Restrictions will be limited in scope and duration to what is reasonably necessary.

6.3 You may seek review at support@nyayassist.ai. The Company will consider relevant information and restore affected access when the basis for the restriction is resolved. A suspension does not automatically establish a breach or extinguish a refund entitlement. Cancellation, termination-related refunds and any adjustment of charges will be handled under the Refund and Cancellation Policy and mandatory law.

7. Changes, Precedence and Contact

7.1 Material changes to this Policy will be notified through the registered email address or the Services before they take effect, ordinarily at least 30 calendar days in advance. A shorter period may be used where reasonably necessary for a legal requirement or an urgent security risk, with an explanation where permitted. Changes will not retrospectively impose charges or reduce purchased entitlements during an existing paid term without your agreement or an appropriate remedy under the Refund and Cancellation Policy.

7.2 A signed agreement that expressly varies a provision of this Policy will govern that provision for the relevant customer, subject to mandatory law. Otherwise, this Policy governs fair-use matters if inconsistent with general fair-use wording in the Terms. It does not override the Privacy Policy on personal-data handling or the Refund and Cancellation Policy on cancellation and refunds. Nothing in this Policy restricts rights or remedies that cannot lawfully be excluded.
