Terms of Use
Last Updated: 29 October 2026
These Terms of Use ("Terms") govern Case Tracking by NyayAssist, the court-case tracking service of NyayAssist, on the web and in our "Case Tracking" mobile apps for iOS and Android, and its related interfaces, updates, alerts and support ("Case Tracking" or "Services"). The Services are operated by Hyperboost AI Solutions Private Limited ("Company", "NyayAssist", "we", "us" or "our"). "Customer" or "you" means the individual or organisation purchasing the Services. An "Authorised User" is an individual permitted to use the Customer's purchased access. References to your use include use by your Authorised Users, where relevant.
These Terms apply to Case Tracking and supplement the NyayAssist Terms of Use. For Case Tracking, these Terms prevail where the two differ. Other NyayAssist features are governed by the NyayAssist Terms of Use, and a Case Tracking purchase includes other features only where the plan or Order says so.
1. Acceptance and Contract Documents
1.1 You accept these Terms through the affirmative acceptance step presented during registration or purchase, or by signing an order that expressly incorporates them. You must be at least 18 years old and legally competent to contract. A person accepting for an organisation represents that they have authority to bind it. An Authorised User must comply with the account, use and confidentiality requirements applicable to their access.
1.2 An "Order" means the plan and commercial details expressly accepted by you at checkout and confirmed by the Company, or a written order accepted by both parties. It identifies the purchased entitlement, price, term and other applicable purchase details. The contract for that Order is formed when the Company confirms acceptance of the purchase or both parties accept the written order. A payment failure does not create paid access. If payment is collected for an order the Company does not accept, the amount will be returned.
1.3 The Case Tracking Fair Use Policy and Refund and Cancellation Policy supplied with the purchase are incorporated into the contract. The Case Tracking Privacy Policy explains personal-information handling and the commitments applicable to that handling; its acknowledgment does not substitute for consent where consent is separately required. An Order does not override those privacy commitments merely by referring generally to these Terms.
1.4 A signed agreement expressly varying a provision governs that provision for the relevant Customer, subject to mandatory law. Otherwise, the Refund and Cancellation Policy governs cancellation and refund matters, and the Fair Use Policy governs fair-use matters, over inconsistent general wording in these Terms. The Order governs the specific price, term and entitlements you accepted; it does not silently waive a more favourable refund promise made at purchase or a right that cannot lawfully be excluded. Sections 14 and 15 govern contractual liability and indemnity across the contract documents. A departure from those Sections, or an indemnity to be given by the Company, requires a written agreement expressly identifying that departure and accepted by an authorised representative of the Company; a general service description, privacy commitment or policy reference does not create it. No general website or other-product terms override this Case Tracking contract unless expressly agreed.
2. Services and Purchased Entitlements
2.1 Case Tracking helps Users follow supported court and tribunal proceedings and organise available case information, updates and reminders. The Services are offered in India only. The Order and purchase disclosures define the supported functions and courts, number of cases and users, refresh arrangements, alert channels, usage limits and access period. A feature or jurisdiction not included in that description is not included merely because another NyayAssist product offers it.
2.2 Access will be provisioned according to the activation arrangements disclosed before purchase. Digital delivery, non-delivery and failed activation are addressed in the Refund and Cancellation Policy. Required customer steps and technical requirements must be disclosed before purchase; they will not be introduced afterwards to avoid an agreed delivery obligation.
2.3 No perpetual licence, lifetime updates, unlimited usage, public API, bulk-data licence, particular uptime percentage or guaranteed response time is included unless expressly stated in the Order. A one-time payment does not, by itself, define the duration of access or future maintenance.
3. Licence, Accounts and Authorised Users
3.1 During the purchased access period, and subject to payment and compliance with the contract, the Company grants you a limited, non-exclusive, non-transferable licence to use the Services for your lawful professional work and, where applicable, the work of the organisation identified in the Order. Work undertaken for clients in the ordinary course of legal practice is permitted. Access may be suspended or terminated only as provided in the contract or required by law.
3.2 Each Authorised User must use their assigned access method. You must keep registration and billing details accurate, manage permissions and remove access when an individual's authority ends. Individual credentials must not be shared. You are responsible for the acts and omissions of your Authorised Users in connection with the Services as if they were your own, and for access you permit through your account. You must take reasonable steps to prevent and report unauthorised access. This provision does not transfer responsibility for a security failure caused by the Company; any liability of the Company remains subject to Section 14.
3.3 Notify support promptly of suspected account compromise. Account recovery and material changes to administrative control may require proportionate verification. The Company will not treat mere possession of a case number, a public court record or another person's email address as sufficient authority to take over an account.
4. Fees, Renewal and Cancellation
4.1 The price, taxes, mandatory charges, payment period and any separately authorised add-ons are those disclosed and accepted in the Order. Additional paid usage requires prior disclosure and your authorisation. The Company will not impose an undisclosed usage fine or automatically move you to a higher-priced plan.
4.2 Recurring debits require the necessary express payment authorisation and clear renewal disclosures. Trials do not convert to paid access without the required authorisation. Future price changes must be notified before renewal, with an opportunity to stop renewal. No retrospective increase applies to the existing paid term.
4.3 Cancellation methods, effective receipt of cancellation, access until expiry, billing-error reversals, ordinary no-proration treatment, refund exceptions, processing arrangements and plan changes are governed by the Refund and Cancellation Policy. These Terms do not make a mandatory refund discretionary or replace it with a compulsory service credit.
4.4 If a properly invoiced amount remains overdue, the Company may restrict the affected paid access after notice identifying the amount and providing a reasonable opportunity to pay or raise a genuine dispute. It will consider the dispute in good faith and keep any restriction proportionate. Interest, late fees or recovery charges apply only if expressly agreed before they arise and legally recoverable.
4.5 Purchases made through the Apple App Store or Google Play are billed by Apple or Google and are also subject to their terms. Renewal is managed in your Apple or Google account, and refunds for those purchases follow the Refund and Cancellation Policy and the app store's process.
5. Fair Use and Customer Responsibilities
5.1 You and your Authorised Users must comply with the Fair Use Policy, purchased limits, lawful access restrictions and applicable professional duties. Prohibited conduct includes unauthorised account access, evasion of limits or access controls, unauthorised automated extraction, resale of access, malware, service disruption and unlawful use or disclosure of case information.
5.2 You must have the authority and permissions needed for information you provide and recipients you configure. Do not send court-account passwords, one-time passwords, banking credentials, privileged advice or confidential documents through an unsupported field or support channel. Protect client confidentiality and restrictions concerning children, protected identities, sealed records and publication restraints. A public record is not unrestricted permission for every further use.
5.3 Ordinary use within an entitlement is not misconduct merely because it is frequent or commercially valuable. Measurement, restrictions on reaching a limit, protective measures and review of a suspected breach follow the Fair Use Policy. No penalty or forfeiture arises automatically from an allegation.
5.4 If you add client details or send listings or reminders to a client through the Services, you confirm that you have that client's permission to do so, and you are responsible for those messages. Client details you add are Customer Information.
6. Court Records, Updates and Professional Responsibility
6.1 Case Tracking is a private software service. It is not a court registry, an official court notification system or a provider of certified copies. Case data comes from eCourts and High Court websites. Case Tracking is not affiliated with any court or government. The Company does not claim court or government affiliation or endorsement merely because the Services display information from a public source.
6.2 Court and other source systems may be delayed, unavailable, corrected, restructured or subject to access restrictions. Matching, retrieval, processing and delivery may also encounter errors. A missing result or absence of an alert does not establish the absence of a case, hearing, order, filing or change. A refresh timestamp is not a certification that the source record is complete or current.
6.3 You must independently verify the correct case, hearing dates, operative orders, limitation periods, procedural deadlines and required action against the authoritative record. Maintain an appropriate independent diary and review process. Alerts are administrative assistance and do not constitute service of process or determine when a statutory or court-ordered period begins or ends.
6.4 The Services do not provide legal representation, a legal opinion or advice on a particular matter. Use does not create an advocate-client relationship with the Company. The Company does not undertake to manage a matter, supervise your Authorised Users or discharge your professional obligations. You remain responsible for your professional judgment, verification of records and deadlines, advice, appearances, filings and communications with clients and courts. The Company is not responsible for loss to the extent caused by your failure to meet these responsibilities. Any liability otherwise attributable to the Company is subject to Section 14.
7. Customer Information, Ownership and Processing
7.1 "Customer Information" means information you supply to configure or use Case Tracking, such as case selections, watchlists, reminder settings, client details and support material. As between the parties, you retain the rights you hold in that information. Neither party acquires ownership of a court record or another person's information merely because it is retrieved, displayed or selected in the Services.
7.2 You grant the Company a limited permission to host, reproduce, organise, retrieve, transmit and otherwise process Customer Information only to provide the purchased functions, support and secure the Services, carry out your lawful instructions, and meet a specific legal requirement, as described in the Privacy Policy. This is not a perpetual licence for unrelated commercial exploitation. It continues after access ends only for permitted retention, closure and legal purposes.
7.3 Processing roles depend on the activity. The Company determines its account, billing, security and independently maintained source-dataset activities. Where it processes an organisation's private watchlists or reminders solely on documented instructions, it acts on that organisation's behalf. Each party remains responsible for duties attaching to the processing it controls. The Customer does not warrant consent from every person named in a public record merely by purchasing the Services.
7.4 The Company will not sell or rent private watchlists or use Customer Information for targeted advertising, AI-model training, fine-tuning, unrelated model evaluation or commercial benchmarking. The Company does not send Customer Information to any AI provider. If you add a tracked case to a NyayAssist project, the NyayAssist Terms of Use and Privacy Policy govern that project.
7.5 Relevant providers may process information for hosting, authentication, payments, alerts, security or support, as described in the Privacy Policy. Providers acting on the Company's behalf must be subject to appropriate confidentiality, purpose and security obligations. Their separate legal identity does not remove the Company's responsibility for processing on its behalf. Location, retention, requests, incident handling and lawful disclosure are addressed in the Privacy Policy and any expressly agreed data-processing terms. Contractual claims against the Company concerning such processing are subject to Section 14, without limiting a statutory responsibility or remedy that cannot lawfully be limited.
8. Confidentiality
8.1 Each party must protect the other's non-public information received in connection with the Services, use it only for the contract or another permitted legal purpose, and limit access to persons who need it and are subject to appropriate confidentiality duties. Private watchlists and the association of a Customer with selected cases may be confidential even where the underlying court records are public.
8.2 These duties do not cover information the receiving party can demonstrate was lawfully known without restriction, independently developed without use of the confidential information, lawfully received from another source without restriction, or publicly available without breach of a duty. Disclosure required by law must be limited to the requirement; advance notice will be given where lawful and reasonably practicable.
8.3 Neither submission of information nor these Terms constitutes consent to waive professional confidentiality or legal privilege. The availability of privilege depends on the law and circumstances, and the Company does not guarantee that every communication or record in the Services is privileged. Confidentiality duties continue while the information remains confidential, subject to lawful retention and disclosure.
9. Intellectual Property and Feedback
9.1 The Company and its licensors retain rights in the Case Tracking software, interfaces, brand and original materials, subject to rights in underlying court records and third-party content. No licence is granted beyond the rights expressly stated. You must not copy, resell, decompile or reverse-engineer protected components except where authorised or a restriction cannot lawfully be imposed. Permitted exports and lawful direct access to public court records are not prohibited.
9.2 You may provide voluntary suggestions. The Company may use non-confidential suggestions to improve the Services without a payment obligation, but this does not grant a licence to identifiable case content, confidential information or personal data for unrelated use. The Company may not use your name, logo, case selections or client identity in publicity without your prior permission.
10. Third-Party Services and Integrations
10.1 External court portals and services you independently select have their own access conditions and notices. You are responsible for complying with those conditions when using them directly. The Company is responsible for the access methods it chooses for its own retrieval activities; these Terms do not authorise bypassing a source's access restrictions.
10.2 An optional external-account integration, if offered, operates within the permissions you authorise and may be disconnected through the available controls. The Company does not warrant the availability or performance of independent court portals, third-party services selected by you, telecommunications networks or your devices. It is not liable for a failure attributable to those systems and beyond its reasonable control, except to the extent the Company caused or contributed to the failure or law requires otherwise. Any liability for the Company's own obligations, including obligations performed through its appointed providers, is subject to Section 14.
11. Maintenance, Changes and Evaluation Features
11.1 The Company may maintain, patch and improve the Services. It will use reasonable efforts to limit disruption and give advance notice of planned material disruption where practicable. Support is provided through the channels and scope disclosed for the purchased plan. No separate service-level guarantee is created by a general response estimate.
11.2 Changes will not retrospectively impose charges or remove material purchased functionality during a paid term without your agreement or an appropriate remedy under the Refund and Cancellation Policy. If a supported source becomes unavailable or lawful retrieval is no longer feasible, the Company will assess the effect on the purchased service and communicate a material limitation. The discontinuance of material paid coverage is addressed under that Policy.
11.3 A feature is treated as beta, trial or evaluation-only only where it is identified as such before you choose it. Additional limitations must be disclosed with that feature. That designation does not convert the whole paid Services into an experimental product or remove a mandatory remedy. You should not depend on an evaluation feature as your sole means of meeting a professional deadline.
12. Service Commitments and Warranty Qualifications
12.1 The Company will provide the material functions expressly agreed for the purchased Services. It does not guarantee uninterrupted availability, complete court coverage beyond the agreed scope, error-free source records, successful delivery of every alert or a particular litigation or professional outcome.
12.2 Except for the material functions expressly agreed in the Order and obligations that cannot lawfully be excluded, the Services and source information are provided on an "as available" basis. To the fullest extent permitted by law, the Company excludes implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness and non-infringement. No representation is made that the Services will meet an undisclosed special requirement or produce a particular legal, commercial or professional outcome. These qualifications do not remove an express purchased function, privacy commitment or refund entitlement. Any liability for breach of an express or implied obligation remains subject to Section 14.
13. Suspension and Termination
13.1 Restrictions for suspected misuse follow the Fair Use Policy. The Company may suspend affected access where reasonably necessary for an urgent security risk, unlawful activity, a binding legal requirement or material harm, and will give notice and review the restriction as provided in that Policy. An ordinary plan limit is administered as a limit, not automatically as misconduct.
13.2 The Company may terminate an affected Order for a material breach that remains unremedied after notice identifying the breach and a reasonable opportunity to remedy it. It may terminate sooner where the breach cannot reasonably be remedied, there is a repeated material breach after a prior warning, continued access would create a material security or legal risk, or a binding requirement demands termination. Overdue-payment action is subject to Section 4.4. The Company may restrict the affected account, functionality or Authorised User as reasonably necessary to protect the Services and other users, consistently with the Fair Use Policy.
13.3 You may stop renewal under the Refund and Cancellation Policy. You may also terminate an affected Order for the Company's material breach if it fails to remedy the breach within a reasonable period after notice, or where the breach cannot reasonably be remedied. This process does not defer an urgent or mandatory remedy. Company discontinuance and material loss of a paid function are governed by that Policy.
13.4 On expiry or termination, the affected licence ends and new tracking and alerts cease unless the Order expressly provides otherwise. Accrued charges remain payable, subject to valid disputes and refunds. Suspension or termination does not automatically forfeit every prepaid amount. Refunds, unused prepaid value and remedies follow the Refund and Cancellation Policy and mandatory law.
13.5 Export and account-closure arrangements will be disclosed for the purchased Services. The Company will not deliberately obstruct an agreed export merely because you cancelled renewal, subject to proportionate security or legal restrictions. Information will be retained and deleted under the Privacy Policy, with limited backup and legal-retention exceptions. Account deletion does not delete an official court record.
14. Limitation of Company Liability
14.1 Subject to Section 14.3, the Company is not liable for indirect, consequential, special, incidental, exemplary or punitive loss or damages, or for loss of profit, revenue, business opportunity, anticipated savings or goodwill, whether such financial or commercial loss is direct or indirect, arising from or connected with the Services. This applies whether the claim is framed in contract, tort, negligence, breach of statutory duty or otherwise, and whether or not the possibility of the loss was communicated to the Company. The Company is not liable for loss to the extent caused by your failure to verify authoritative court records, maintain an independent diary or act on a deadline as required under Section 6.
14.2 Subject to Sections 14.3 and 14.4, the Company's total aggregate monetary liability arising from or connected with the affected Services, under any legal theory, shall not exceed the Relevant Fees actually paid by you to the Company. The cap is calculated as follows:
14.2(a) For a subscription, "Relevant Fees" means the fees actually paid for the affected Services for the discrete quarterly, 12-month or other subscription term agreed in the Order in which the first act, omission or event giving rise to the claim occurred. The subscription term, rather than the frequency of instalment payments, determines the relevant period. For a separately priced assignment or one-time engagement expressly identified in an Order, Relevant Fees means only the fees actually paid for that assignment or engagement. A court case merely tracked through a subscription is not a separately priced assignment.
14.2(b) Where the event occurs before activation or after expiry, the relevant period or assignment is the one under which the affected Services were supplied or were to be supplied and to which the claim relates. Relevant Fees exclude unpaid amounts, taxes, third-party pass-through charges and fees for other subscription terms, renewals, assignments or products. No rolling 12-month lookback or aggregation of unrelated purchase periods applies.
14.2(c) All claims arising from the same act, omission or event, or a series arising from the same underlying cause, are allocated to the period or assignment in which the first such event occurred, even if the consequences continue into a renewal term. All claims allocated to the same period or assignment share a single aggregate cap equal to its Relevant Fees. Multiple claims, legal grounds, tracked cases, Authorised Users or persons claiming through you do not multiply that cap. To the extent permitted by law, the Company's personnel and representatives acting within their authority share, and do not add to, this contractual cap.
14.3 Nothing in these Terms excludes or limits liability for the Company's fraud or a liability or statutory remedy that cannot lawfully be excluded or limited. Subject to that exception, the exclusions and cap in this Section apply also to contractual claims concerning confidentiality, personal information, security, data loss and the Company's appointed service providers; a breach in those areas does not create a separate uncapped contractual liability. These Terms do not bind a regulator or restrict the rights of a person who is not a party to the contract. Mandatory consumer protections prevail where applicable.
14.4 The aggregate cap takes account of damages, service credits, refunds and other payments already made for the same service failure, so that the same loss or charge is not recovered twice. The cap does not authorise the Company to withhold or reduce a refund or billing reversal due under the Refund and Cancellation Policy or law. Any amount already received for the same loss or charge will be credited against a further recovery to the extent permitted by law. You must take reasonable steps to mitigate avoidable loss. This Section limits the Company's liability only; it does not cap your indemnity under Section 15 or reduce your obligation to pay properly accrued fees.
15. Customer Indemnity
15.1 You shall indemnify, defend and hold harmless the Company, its affiliates and their respective directors, officers, employees and authorised representatives ("Indemnified Parties") against claims, proceedings, liabilities, damages, losses, commercially reasonable settlements, and reasonable documented legal and defence costs, to the extent arising from: (a) a material breach of these Terms or the Fair Use Policy by you or an Authorised User; (b) Customer Information or materials you provide, where their authorised processing infringes another person's rights or breaches a duty of confidentiality, privacy or other legal restriction; (c) unlawful use, unauthorised resale, access-control circumvention or unauthorised disclosure of information by you or an Authorised User; or (d) a claim by your client or another person arising from your professional advice, representation, filings, deadline management or other professional conduct. This indemnity covers the Indemnified Parties' own losses and third-party claims, but does not apply to the extent a loss is caused by the Company's breach, negligence, fraud or wilful misconduct, or cannot lawfully be indemnified.
15.2 The Company may control the defence and settlement of a covered third-party claim through counsel of its choice, acting reasonably. You shall provide reasonable cooperation and reimburse reasonable documented defence costs as they are incurred, to the extent the claim falls within Section 15.1; recovery is not conditional on a final judgment. The Company will notify you as soon as reasonably practicable and consult you on a proposed settlement. A delay in notice reduces your responsibility only to the extent it materially prejudices the defence. The Company may enter a commercially reasonable monetary settlement of a covered claim, but will not impose an admission or non-monetary obligation on you without your consent, not to be unreasonably withheld. You may not settle a claim in a manner that admits liability, imposes an obligation on, or fails fully to release an Indemnified Party without the Company's prior written consent.
15.3 Your obligations under this Section are not subject to the Company's fee-based cap or loss exclusions in Section 14 and survive expiry or termination for matters arising from your or your Authorised Users' conduct during the contract. Amounts recovered must reflect a covered loss or liability and reasonable associated costs, rather than an automatic penalty or duplicate recovery. The Company does not give a reciprocal indemnity unless expressly agreed in a written agreement accepted by its authorised representative, subject to any responsibility or remedy that cannot lawfully be excluded.
16. Events Beyond Reasonable Control
16.1 A party is excused from performance only to the extent and for the period it is prevented by an event beyond its reasonable control that it could not reasonably avoid or overcome. It must notify the other party of a material effect as soon as reasonably practicable and take reasonable mitigation and restoration steps. A routine fault or supplier problem is not automatically such an event.
16.2 This provision does not excuse payment for Services already properly supplied, permit retention of a refund due by law or under the Refund and Cancellation Policy, or remove duties to protect information or make statutory notifications. If the event prevents delivery of a material purchased service, cancellation and financial consequences will be assessed under that Policy and applicable law.
17. Changes to These Terms and Notices
17.1 The Company will publish the current Terms with their last-updated date. Material changes will be notified through the registered email address or the Services before taking effect, ordinarily at least 30 calendar days in advance. Shorter notice may be used where necessary for a legal requirement or an urgent protective measure, with an explanation where permitted.
17.2 Changes do not retrospectively alter an accepted price, impose a new charge, remove accrued rights or reduce a refund entitlement attached to an existing purchase. A materially adverse change to an existing paid Order requires your agreement or an appropriate cancellation and refund remedy. Where express consent is required, notice or continued use alone is not a substitute.
17.3 You must keep account contact details current. Contractual notices may be sent through the registered email address or the notification mechanism identified for the Services. A notice is not conclusively treated as received merely because it was sent to an address known to be invalid. Cancellation requests remain subject to the effective-receipt rule in the Refund and Cancellation Policy.
18. Governing Law, Disputes and Grievances
18.1 These Terms are governed by the laws of India. Subject to mandatory jurisdiction and statutory remedies, courts in Mumbai, Maharashtra will have exclusive jurisdiction only where they otherwise have jurisdiction under law. If no Mumbai court has such jurisdiction, the competent court will be determined under applicable law. This clause does not prevent a consumer from approaching a competent consumer commission or an individual from approaching an authority entitled to hear their complaint.
18.2 The parties may first attempt a good-faith resolution through the support and grievance channels. This is not a compulsory waiting period, a restriction on urgent relief or an agreement shortening a statutory limitation period. No mandatory arbitration arrangement is created by these Terms.
18.3 Support requests and complaints may be sent to support@nyayassist.ai. Grievances may be escalated to Yash Rane, Grievance Officer, at grievance@nyayassist.ai. A complaint will be acknowledged within 24 hours of receipt and resolved within 15 calendar days of acknowledgement. A shorter mandatory period prevails. Personal-information requests and grievances follow the Privacy Policy.
19. General Provisions
19.1 You may not assign, transfer or sublicense the purchased account or contract without the Company's prior written consent. The Company may transfer the contract in a genuine merger, restructuring or transfer of the relevant business where the successor assumes its obligations and your material rights and protections are preserved. Required notice and consent must be obtained; no transfer may unlawfully prejudice a consumer.
19.2 A failure or delay to enforce a provision is not a waiver. If a competent authority holds a provision invalid or unenforceable, it will be severed to the extent legally possible, and the remaining provisions will continue where they can operate lawfully. Severability does not validate an otherwise unlawful restriction.
19.3 These Terms, the accepted Order, incorporated Case Tracking policies and any signed agreement form the contract for the Services. A purchase-order form supplied by the Customer does not change it unless expressly accepted by the Company. Nothing here excludes liability for fraud or an actionable pre-contract representation, or removes an express product or refund promise accepted with the purchase.
19.4 The parties remain independent contractors. The contract does not create a partnership, employment, agency or authority to bind the other party. Provisions concerning accrued payments, confidentiality, permitted retention and deletion, intellectual property, liability, covered third-party claims and dispute resolution survive only to the extent required by their purpose and lawful terms.
